Military Informal Complaint Process
(Active-duty Airmen)
Is available as an alternative to filing a formal complaint. This process allows an individual to decide on the most practical means to address/resolve concerns, while working with the chain of command. Associated Timeline: There are no time limits for the informal process.
Military Formal Complaint Process
Is available when individuals believe their concerns of unlawful discrimination, harassment, hazing, or bullying can only be addressed through a formal process or were dissatisfied with the informal process.
Associated Timeline: Individuals should submit allegations to the EO office no later than 90 calendar days after the alleged offense. The complainant must provide sufficient justification or extenuating circumstances for review and subsequent approval by the installation commander when the timeline window has been exceeded.
Civilian Pre-Complaint Process
(Current or former federal employee and applicants)
An aggrieved person who believe they have been discriminated against based on any of the protected categories, must initiate contact with an EO counselor prior to filing a complaint, to attempt informal resolution. Furthermore, protection also extends to anyone who believes they have been retaliated against for opposing discrimination or for participating in the complaint process.
Associated Timeline: Under 29 CFR part 1614.105, 45-calendar days of the incident date or date s/he becomes aware of the personnel action.
Alternative Dispute Resolution
ADR is a voluntary option offered to everyone. Its process involves mediation, facilitation, structured negotiation, other problem solving techniques, or a combination thereof, which often produce more efficient and effective outcomes.
Civilian Formal Complaint Process
When there is no resolution at the informal stage, the aggrieved person has the option to file a formal complaint; however, this must be accomplished, in writing, within 15 calendar days of receipt of the notice of final interview from the informal complaint process.
